  • Maintaining the confidentiality of your credentials
  • Restricting unauthorised access to your account
  • Informing the appropriate Capacity contact if you suspect unauthorised access

Access may be restricted or suspended where reasonably necessary for security, legal compliance, misuse prevention or contractual reasons.

4. Organisation Responsibilities

Organisations using Capacity are responsible for the research activities they conduct through the platform.

This includes responsibility for:

  • Research study content

  • Participant recruitment
  • Required notices and disclosures

Capacity does not replace an organisation's responsibility for designing and conducting lawful and appropriate research.

5. Research Participants

Participation in individual research studies may be subject to additional terms, notices, eligibility requirements, incentive arrangements or privacy information provided by the organisation conducting the research.

Those study-specific terms may apply in addition to these website Terms.

6. Intellectual Property

Unless otherwise stated, the Capacity website, platform, software, branding, interface elements, graphics and original website content are owned by or licensed to the relevant Capacity/Internet Research Bureau entity and are protected by applicable intellectual property laws.

You may not reproduce, modify, distribute, commercially exploit or create derivative works from protected Capacity materials without appropriate authorisation.

Research content, questionnaires, customer data and other materials supplied by customers remain subject to the ownership and licensing provisions agreed between the relevant parties.

7. Customer and User Content

Where users upload, submit or process content through Capacity, they are responsible for ensuring that they have the rights and permissions necessary to use that content.

Content must not:

  • Violate applicable law
  • Infringe intellectual property rights
  • Breach confidentiality obligations
  • Contain unlawful or malicious material
  • Be used to conduct prohibited or deceptive activities

8. Third-Party Services and Integrations

Capacity may support integrations with third-party systems.

Third-party services may be governed by their own terms, privacy policies and availability conditions.

Capacity is not responsible for third-party services outside its reasonable control.

9. Platform Availability

We aim to provide a reliable service, but we do not guarantee that the website or platform will always operate without interruption or error.

Access may occasionally be affected by:

  • Maintenance
  • Security updates
  • Technical failures
  • Third-party services
  • Network conditions
  • Events outside reasonable control

Specific uptime commitments, support levels or service-level obligations apply only where expressly included in an applicable written agreement.

10. Product Features and Roadmap

Website descriptions are intended to explain Capacity's functionality generally.

Availability may vary according to configuration, implementation and contractual arrangements.

Features identified as planned, future, proposed, roadmap or similar are not commitments that those features will be released by a particular date or at all.

In particular, features described on the current website as future AI summaries or automated translation are roadmap items rather than current functionality.

11. Fees and Commercial Terms

Where paid Capacity services are provided, pricing, billing arrangements, subscriptions, usage limits, implementation requirements and other commercial conditions will be governed by the applicable proposal, order form, agreement or other written commercial arrangement.

12. Confidentiality

Where confidential information is exchanged in connection with Capacity, the applicable confidentiality obligations may be established through a separate agreement between the relevant parties.

Users should not submit confidential or sensitive information through general website enquiry forms unless necessary and appropriate.

13. Disclaimer of Warranties

The public website and general website content are provided for informational purposes.

To the extent permitted by applicable law, we do not guarantee that:

  • All website information will always be complete or error-free
  • The website will always be available
  • Every Capacity feature will be suitable for every research requirement
  • Third-party integrations will remain continuously available

Specific contractual warranties, if any, will be governed by the applicable written agreement.

14. Limitation of Liability

To the extent permitted by applicable law, Capacity and the relevant Internet Research Bureau entity will not be responsible for indirect, incidental, special or consequential losses arising solely from reliance on general website information.

Any liability relating to paid platform services should be governed by the applicable commercial agreement.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

15. Suspension and Termination

Access to Capacity may be suspended or terminated where:

  • These Terms are materially breached
  • Use creates a security risk
  • Use violates applicable law
  • Required fees remain unpaid under an applicable agreement
  • Suspension or termination is otherwise permitted under the relevant commercial agreement

16. Changes to These Terms

These Terms may be updated as Capacity develops or legal and operational requirements change.

The latest version should be published on this page with an updated revision date.

17. Governing Terms

Where an organisation has entered into a separate written agreement for Capacity services, that agreement will govern the commercial relationship and will take precedence in the event of a conflict with these general website Terms to the extent specified in that agreement.
